HIPAA Notice

This website is not a secure channel for health information. Do not send medical records, test results, obstetric history or any other clinical detail through the enquiry form or by ordinary email. If we need those documents we will tell you how to send them securely.
Who handles health information, and where
Surrogacy Institute of Hawaii is the agency arm of the Fertility Institute of Hawaii. Medical screening, evaluation and treatment are carried out by the clinic and by the other licensed providers involved in a journey. Those providers hold your clinical record and are the ones bound by the Health Insurance Portability and Accountability Act (HIPAA) in respect of it.
Each provider gives you its own Notice of Privacy Practices describing your rights over the record it holds. Ask the provider directly for a copy; those notices govern that record, not this one.
What the agency sees
In coordinating a journey we come to hold health information about surrogates and intended parents — screening outcomes, pregnancy milestones, insurance details. We use it only to do the work you have engaged us for: screening, matching, coordinating care, administering payments, and supporting you through delivery and afterwards.
We share it only with the people who need it for that work — your matched surrogate or intended parents as you have agreed, the treating clinic, the attorneys drafting your agreements, the escrow administrator, and the insurance reviewer — or where the law requires it. We do not sell it and we do not use it for marketing.
Consent and authorisation
Sharing clinical information between the parties to a journey happens under the written releases and authorisations you sign. You can withdraw an authorisation in writing at any time; that stops future sharing, but cannot undo sharing that has already taken place.
Your rights
Where HIPAA applies to a record about you, you generally have the right to see it and get a copy, to ask for corrections, to know who it has been disclosed to, to ask for confidential communication, and to complain without being penalised for it. Exercise those rights with the provider that holds the record.

If you believe your health information has been mishandled, contact us at surrogacyinstitute@gmail.com or +1 808 380 6835. You may also complain to the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for making a complaint.
